This Privacy Policy and Terms of Use (“Agreement”) governs your access to and use of the StakeSmart AI mobile application, website, and all related services (collectively, the “Platform”). By downloading, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree to these terms, you must not use the Platform.

StakeSmart AI reserves the right to update or modify this Agreement at any time. Your continued use of the Platform following any changes constitutes your acceptance of the revised terms. It is your responsibility to review this Agreement periodically for changes.

2. Eligibility

The Platform is intended for users who are at least 18 years of age. By creating an account or using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are under 18, you are strictly prohibited from using the Platform.

StakeSmart AI reserves the right to request proof of age at any time and to suspend or terminate accounts that are found to belong to individuals under the age of 18. If we discover that we have collected personal data from a minor, we will delete the account and all associated data without notice.

Users are also responsible for ensuring that their use of the Platform complies with all applicable local, national, and international laws and regulations in their jurisdiction. Access to sports prediction content may be restricted or prohibited in certain regions, and it is your sole responsibility to determine whether your use is lawful.

When you use our messaging feature, we collect the content of messages you send. We do not monitor messages in real time but reserve the right to review content that is reported by other users or flagged by automated systems.

When you participate in prediction challenges, we collect your predictions, challenge results, and Points earned or redeemed.

4.5 Cookies

7. Push Notifications

We use OneSignal to deliver push notifications. You can control which notifications you receive through the app settings. You may also disable notifications entirely through your device settings at any time. We adhere to a daily notification cap to prevent excessive messaging.

8. In-App Messaging

Users are solely responsible for all content they send through the messaging feature. You must not use messaging to share illegal content, harass other users, distribute spam, or engage in any activity that violates our Terms of Service.

StakeSmart AI is not liable for any content transmitted between users. We reserve the right to suspend messaging access for users who violate these rules.

9. Virtual Points and Prediction Challenges

9.1 Nature of Points

StakeSmart AI awards virtual points (“Points”) for participation in prediction challenges. Points have no monetary value, cannot be exchanged for cash, cannot be transferred to another user, and cannot be redeemed outside of the StakeSmart AI platform. StakeSmart AI reserves the right to modify, suspend, or remove Points balances at any time without prior notice and without liability. Points are forfeited upon account termination.

9.2 Challenge Outcomes

Where multiple users submit a correct prediction, any associated Points reward will be divided equally among all qualifying participants. StakeSmart AI reserves the sole right to determine the outcome of any challenge, including the correct result, qualifying participants, and reward distribution. All challenge outcomes are final.

9.3 Not a Gambling Service

StakeSmart AI is a sports prediction, analysis, and entertainment platform. The Points system and prediction challenges do not constitute gambling, betting, or wagering under any jurisdiction. No real money is staked, wagered, or won at any time. Predictions and analysis are provided for entertainment and informational purposes only. StakeSmart AI does not guarantee the accuracy of any prediction.

10. Data Retention

• Account data is retained for as long as your account is active. You can request deletion at any time.
• Messages are retained for up to 12 months, then automatically deleted.
• Challenge and Points history is retained for the lifetime of your account.
• Website comments and their metadata are retained indefinitely to support follow-up comment moderation.
• Usage analytics are retained in aggregated, anonymised form indefinitely.

11. Your Rights

You have the right to:

• Access — request a copy of the personal data we hold about you.
• Correction — request that we correct inaccurate personal data.
• Deletion — request that we erase your personal data. This does not include data we are legally obliged to retain for administrative, legal, or security purposes.
• Export — request an exported file of your personal data in a portable format.

13.1 For Entertainment and Information Only

All match predictions, probability scores, AI-generated insights, statistical analysis, and recommendations provided by StakeSmart AI are generated for entertainment and informational purposes only. They do not constitute professional sports, financial, betting, or gambling advice of any kind. StakeSmart AI is not a licensed betting operator, financial advisor, or sports consultancy.

13.2 No Guarantee of Accuracy

StakeSmart AI makes no representation, warranty, or guarantee — express or implied — regarding the accuracy, completeness, reliability, or timeliness of any prediction or analysis provided through the Platform. Sports outcomes are inherently uncertain. The fact that StakeSmart AI provides a predicted outcome does not mean that outcome will occur.

Past prediction accuracy is not indicative of future results. AI models, statistical models, and data-driven forecasts cannot account for all variables that influence a live sporting event, including but not limited to:

• Last-minute team changes, injuries, or suspensions
• Weather and pitch conditions
• Referee decisions
• Player performance on the day
• Errors or delays in third-party data feeds

13.3 No Financial or Betting Advice

Nothing on the Platform should be interpreted as a recommendation to place a bet, stake money, or make any financial decision. StakeSmart AI does not encourage, facilitate, or promote gambling. Any user who chooses to use Platform content in connection with betting or wagering activities does so entirely at their own risk and discretion.

13.4 User Responsibility

By using the Platform, you acknowledge and agree that:

• You will not solely rely on StakeSmart AI predictions when making any financial or betting decision
• You understand that all predictions carry inherent uncertainty
• StakeSmart AI bears no responsibility for any outcome — financial or otherwise — resulting from your use of predictions or analysis provided by the Platform
• You are responsible for verifying any information independently before acting on it

13.5 Third-Party Data

Match data, statistics, and live scores are sourced from third-party providers. StakeSmart AI does not guarantee the accuracy or completeness of third-party data and is not liable for errors, delays, or omissions in data supplied by external sources.

14. Password Resets

If you request a password reset, your IP address will be included in the reset email for security purposes.

15. Limitation of Liability

To the maximum extent permitted by applicable law, StakeSmart AI, its founders, directors, employees, contractors, and affiliates shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Platform. This includes, without limitation:

• Loss of virtual Points, rewards, or challenge progress
• Inaccurate, delayed, or incomplete match predictions, statistics, or analysis
• Financial losses incurred from decisions made based on information provided by the Platform
• Interruptions, outages, or technical failures of any Platform feature including messaging, notifications, and live data
• Unauthorised access to your account resulting from your failure to protect your login credentials
• Actions or content of other users, including through the messaging feature

StakeSmart AI provides predictions and analysis for entertainment and informational purposes only. The Platform does not provide financial, betting, or gambling advice. Any decision you make based on information from the Platform is made entirely at your own risk. Our total aggregate liability to any user for all claims arising out of or relating to this Agreement shall not exceed the total amount paid by that user to StakeSmart AI in the twelve (12) months preceding the claim, or ten US dollars ($10), whichever is greater.

16. Platform Changes

StakeSmart AI reserves the right to modify, suspend, or permanently discontinue any feature, including Points, challenges, and messaging, at any time without notice and without liability to users. We may also suspend or terminate any user account found to be abusing the rewards system, manipulating challenge outcomes, or violating our Terms of Service, resulting in immediate forfeiture of all accumulated Points.

17. Dispute Resolution

Any disputes arising from Points balances, challenge outcomes, or reward distribution must be submitted to StakeSmart AI support within 7 days of the relevant event. StakeSmart AI’s decision on all disputes is final and binding.

18. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to this Agreement or the use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Lagos, Nigeria.

If any provision of this Agreement is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining provisions.

Users who access the Platform from outside Nigeria are responsible for compliance with their local laws. StakeSmart AI makes no representation that the Platform or its content is appropriate or available for use in any particular jurisdiction.

19. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the platform after changes are posted constitutes acceptance of the revised policy.
